Business Terms and Conditions for the Sale of Cruises on Pleasure Boats

1. Introductory Provisions
These business terms and conditions govern the relationships between Marcela Bildires
(hereinafter referred to as the “Provider”) and customers (hereinafter referred to as
“Customers”) in the area of sales and brokerage of cruises on pleasure boats.

2. Definition of Terms
“Provider” is Marcela Bildires, with registered office at Hanusova 1537/1a, 140 00 Prague 4,
ID No.: 2345678.
“Customer” is a natural or legal person who enters into a service provision contract with the
Provider.
“Services” include all activities related to the sale and brokerage of cruises on pleasure
boats.

3. Contract
The contract between the Provider and the Customer is concluded upon the Provider’s
confirmation of the order.
The order must contain all relevant information about the services, the Customer’s name,
contact details, and the Customer’s explicit consent to these business terms and conditions.

4. Payments
The Customer undertakes to pay the price for the services in accordance with the Provider’s
price list and according to the payment terms specified in the order or contract.
All payments are due within the terms specified in the Provider’s invoicing.

5. Cancellation Policy
The Customer may cancel the order under the conditions set by the Provider.
In the event of order cancellation, the following cancellation fees apply:
• 14 days or less before the planned start of the service: a full refund is issued
• 7 days or less before the planned start of the service: 50% of the price of the
canceled services
• 2 days before the planned start of the service: 100% of the price of the canceled
services

6. Limitation of Liability
The Provider is not liable for any delays, changes, or cancellations of services caused by
circumstances beyond its control, including but not limited to force majeure, adverse
weather conditions, strikes, political unrest, decisions of authorities, technical problems, or
other unforeseen events.
In such cases, the Provider strives to provide alternative solutions or refunds in accordance
with applicable conditions.

7. Complaints
The Customer has the right to complain about services that were not provided in accordance
with the order or contract.
Complaints must be submitted in writing and without undue delay after the deficiencies are
discovered.

8. International Bank Transfers
The price of the services is considered paid only after the full amount has been credited to
the Provider’s account. The Customer is responsible for setting the payment parameters so
that the amount is not reduced during the transfer. The Provider will, upon request,
communicate the amount to be paid in the currency preferred by the Customer. The same
rules apply to payments made by the Provider to the Customer.

9. Final Provisions
Contractual relationships are governed by the legal order of the Czech Republic. In the event
of language discrepancies, the Czech version of these terms and conditions is decisive.
These general terms and conditions are valid from January 1, 2024.

 

Transport Terms and Conditions

1. Introductory Provisions
These transport terms and conditions govern the relationships between Marcela Bildires
(hereinafter referred to as the “Provider”) and customers (hereinafter referred to as
“Passengers”) in the area of facilitating transport on pleasure boats.

2. Transport Contract
The transport contract between the Passenger and the boat operator (hereinafter referred to
as the “Shipping Company”) is concluded by purchasing a ticket through the Provider.
The Passenger confirms consent to the transport conditions of the Shipping Company and
the Provider at the moment of purchasing the ticket.

3. Responsibility for Transport
The Provider is not the carrier and as such is not responsible for any changes, cancellations
of cruises, or other transport complications that are within the control of the Shipping
Company.
Complaints regarding transport are resolved directly with the Shipping Company.

4. Safety and Conduct on Board
Passengers are required to comply with all safety regulations and instructions from the crew
during the cruise.
The Shipping Company is responsible for the conduct of Passengers on board the boat.

5. Luggage and Special Items
The conditions for the transport of luggage and special items are set by the Shipping
Company, and Passengers commit to comply with them.

6. Force Majeure and Unforeseen Events
The Provider is not responsible for cancellations or changes in transport caused by force
majeure circumstances, such as adverse weather conditions, strikes, political unrest, and
other unpredictable events.

7. Final Provisions
Contractual relationships are governed by the legal order of the Czech Republic. In the event
of language discrepancies, the Czech version of these terms and conditions is decisive.
These general terms and conditions are valid from January 1, 2024.

 

Information about Shipping Companies

1. Introduction
Marcela Bildires (hereinafter referred to as the “Provider”) offers customers (hereinafter
referred to as “Passengers”) brokerage services for purchasing cruises on various shipping
companies’ pleasure boats (hereinafter referred to as “Shipping Companies”). This
document contains basic information about Shipping Companies and alerts Passengers to
specific conditions that may affect the services provided.

2. List of Shipping Companies
The Provider collaborates with various Shipping Companies, the current list of which is
available on the Provider’s website or upon request at sales points.
Each Shipping Company has its own business and transport conditions, which may vary.

3. Business and Transport Conditions of Shipping Companies
Before purchasing tickets, Passengers are required to familiarize themselves with the
business and transport conditions of the respective Shipping Company, which are available
on each Shipping Company’s website or upon request from the Provider.
By purchasing tickets, Passengers confirm that they have been acquainted with theconditions and express their consent to them.

4. Liability
The Provider is not responsible for any changes, cancellations of cruises, or other transport
complications that are within the control of the Shipping Company.
All complaints related to transport are resolved directly with the Shipping Company in
accordance with its transport conditions.

5. Contact and Support
In case of any questions or need for assistance, Passengers can turn to the Provider, who
will provide the necessary information or assist with communication with the Shipping
Company.

6. Final Provisions
Contractual relationships are governed by the legal order of the Czech Republic. In the event
of language discrepancies, the Czech version of these terms and conditions is decisive.
